Terms


The following Terms and Conditions (hereafter referred to as the Agreement) shall govern any use of the Weber Insurance Site, Inc. (hereafter referred to as the Company) website and blog on-line Site (hereafter referred to as the Site).

Each user of the site, whether a current customer, new user or potential customer of the Company agrees hereby that any user of the Site is, by nature of that use, consent to conformity to and compliance with this Agreement.

This Agreement may be modified from time-to-time and users are obligated to review the Agreement as a condition of use.

This Agreement does not cover or modify in any way any agreement with any insurance provider nor is it a contract for insurance coverage. This Agreement is in no way a part of, amendment or addendum to any policy in force or any policy that may be issued by the Company or any of its affiliates. Such policies are stand-alone agreements.

Please read this Agreement in its entirety in order to understand your responsibilities.

Information Collected

We may collect information from you such as name, gender, address, phone number, fax number, e-mail address, member number, group number, provider number, broker number, date of birth, Social Security Number, health plan and primary care physician and/or any other information we need to verify who you are or to determine what information may be made available to you.

This Site incorporates the common practice of cookie generation. A “cookie” is a small piece of code that is saved to a user’s computer which enables streamlined access to the site without having to necessarily reload all previously viewed information. A cookie is not a virus nor is it a tracking tool.

The Site utilizes non-persistent cookies. Non-persistent cookies serve technical purposes like providing seamless navigation through the Site. Cookies are not copied to a user’s hard drive, although they may be written to “virtual memory” or “swap space” on your hard drive depending on the configuration and the operating system of your computer. The Company’s non-persistent cookies are intended to be stored temporarily in your computer’s memory and are used by the Company during active browser sessions.

Access to Account or Personal Insurance Information

Each user of the Site agrees that he/she will not allow any other person or user to have access to any individual account that requires login information such as user name and password or, in some cases account numbers or unique account information.
Any third party access to account or login information must be approved by the Company in writing prior to extension of such access to any third party.

A user(s) may be given passwords to various Company accounts or, the accounts of third party providers approved by the Company and made accessible to users through the Site. Users agree to maintain login, password and unique account numbers and/or identifies confidential.

Any user who believes or suspects that his/her account information, login and password information may have been compromised is urged to contact the company by email address or phone number provided in the site and to do so promptly.

Email and Email Notifications

Your email address may be viewed by other Internet users while in transit to us, therefore, users are encouraged to avoid using email to transmit confidential or personal matters to the Company.

The Company maintains and uses blog postings to communicate important insurance information, trends, programs and other useful information to our customers. If a user wishes to opt out of receiving such information they may do so by requesting they be removed from our email notification list.

Site Security

The Site will, whenever appropriate, utilize secure technologies that encrypt some user information such as passwords and credit card information that may be submitted through our use of a Secure Payment Center.

Although the Company will utilize secure measures, it should be noted that the Company cannot fully guarantee that others, not authorized by the Company, will not and cannot gain unauthorized access to information transmitted to us whereby others misuse the system.

Therefore, all users hereby and as a requirement of and condition for the use of the Site, assume all risks associated therewith and do completely and wholly indemnify and hold the Company, its principals, agents, employees, contractors and third party vendors harmless with respect to any claim, liability and/or damages that may arise as a result of any use of the Site.

Links within the Site

The Site provides users with links as a convenience for accessing information. Some links are links to third party insurance providers with whom the Company is affiliated as an insurance broker.

By use of these links to third party providers, users understand an acknowledge that the services and products marketed and sold by such third party providers and NOT necessarily products or services of the Company and therefore, all users hereby and as a requirement of and condition for the use of the Site, assume all risks associated therewith and do completely and wholly indemnify and hold the Company, its principals, agents, employees, contractors and third party vendors harmless with respect to any claim, liability and/or damages that may arise as a result of any use of links that lead them to third party vendors from whom they purchase products or services.

The Company, by providing links to third party providers, does not necessarily endorse any product or service which may be made available to users. Users accept and acknowledge that the Company hereby disclaims any and all liability for any loss or injury resulting from any users purchase or acceptance of such third party products or services.

User acknowledge by their use and accept the fact that the services and products of third party providers as offered by their independent websites are not necessarily under the control of the Company and therefore, all Users acknowledge by their Use that the Company is not responsible for the contents, security or privacy practices of Companies with whom we may linked.

Users who use third party websites do so with the knowledge that they are subject to the terms and conditions of third party providers as displayed within their website(s) or elsewhere. If a user is not comfortable with accessing third party websites or, with the transmission of information to third parties via their websites, forms or links, they should NOT do so.

Copyrights, Logos, Intellectual Property

User are granted permission to print information contained on the Site so long as such actions are taken for personal and non-commercial use only.

Most of the information in the Site is Copyright © 2009, Weber Insurance Services, Inc., and may not be reused by any person or entity for their personal or business use. Users hereby acknowledge by their use and the terms of this Agreement that the site is the intellectual property of Webers Insurance, Inc.

Written consent is necessary if any user desires to copy, modify or in any way alter and use the content of the site. Many of the logos and marketing lines of third party providers are copyrighted, intellectual property of the companies they represent and they are used by the Company with the consent of those third party providers.

Forms, logos, documents, images and graphical designs used in the Site are the property of the Company and the use of the Site by any User(s) does not convey any rights to replicate or use such content.

Site Modification and User Responsibilities

Content within the site will change from time to time. This Agreement will change from time-to-time. All changes to the site and its content may be made by the Company or its agents without the consent of any User(s).

Users, by their use, are responsible to seek and note changes within the site, especially changes to this Agreement and such responsibility is does not rest with the Company. Users acknowledge and agree hereby that if the Company makes changes to this Agreement, the Company is not obligated to notify each User or customer of such changes.

All changes made to the Site by the Company or its authorized agents are effective upon the moment such change(s) is/are post to the Site. User acknowledge and accept that such changes are in effect when posted and do not expect or demand that the Company notify them of such changes.

Indemnification and Hold Harmless Agreement

User do hereby agree to fully indemnify, defend and hold harmless the Company, its principals, employees, agents, contractors and third party providers against any matters that might arise from use of the Site and do hereby hold the above referenced parties, et, al, from all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from use of the Site and the unauthorized or self-approved use of the Site by any other person(s) who might access your account and thus violate the terms and conditions set forth herein.

Insurance Policy Binding

Absolutely nothing contained within this Site nor the use of the Site itself shall bind any insurance coverage to any user(s). Insurance policy binding cannot be done by email, phone, facsimile or other means not authorized by the Company.

Users understand and acknowledge that use of the Site by them shall NOT constitute a contract for insurance coverage.

Governing Law, Venue and Invalidation of Provisions

Arizona law shall govern the terms and conditions of this Agreement and those rules and regulations set forth by the State of Arizona shall be in effective with respect to the selling and marketing of insurance products and services.

If any claim shall arise from the user of this Site, the only acceptable venue shall be Yavapai County, Arizona.

If any provision of this Agreement is determined by a court having jurisdiction to be invalid, such invalidation shall in no manner impact other provisions contained herein and such non-invalidated provision shall be and remain in full force and effect.
